MerchantWords provides Amazon keyword research tools, search volume estimates, competitive analysis, and related e-commerce optimization services.
3. User Accounts and Registration
As part of the registration process, you shall generate a username and password for your MerchantWords account.
4. Subscription Plans and Billing
Paid plans are billed in advance on a monthly or annual basis through Stripe, our third-party payment processor.
5. Intellectual Property
All rights, title, and interest in and to the Service, its components, Content, and all related intellectual property rights remain with and belong exclusively to MerchantWords, Inc.
6. Acceptable Use Policy
You agree not to:
- Resell, redistribute, or sublicense MerchantWords data without written permission
- Use automated scraping tools, bots, or similar software to access the Service or extract data
- Attempt to circumvent access controls, usage limits, or contractual restrictions
7. Data Accuracy Disclaimer
Search volume and keyword data provided by MerchantWords are estimates derived from proprietary methodologies.
8. Confidentiality
"Confidential Information" means all information disclosed by a party to the other.
9. Indemnification
You shall defend, indemnify, and hold harmless MerchantWords from all damages, settlements, attorneys' fees, and expenses related to any third-party claim.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MERCHANTWORDS SHALL NOT BE LIABLE FOR (A) ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
11. DMCA Notice and Takedown
MerchantWords has adopted a policy toward copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).
12. Governing Law and Jurisdiction
These TOS shall be governed by and construed pursuant to the laws of the State of California.
13. Termination
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.
14. API Usage
If you desire to use any MerchantWords APIs, your use shall be governed by the MerchantWords API License & Terms of Use.
15. Modifications to Terms
We may modify these terms at any time.
16. Miscellaneous
- Assignment: You may not assign or transfer these TOS without MerchantWords's prior written consent.
- Independent Contractors: The parties are independent contractors.
